JUSTICE ARVIND SRIVASTAVA ORAL ORDER 10-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody in Nawanagar P.S.Case No.117/16 for the offence under Sections 272, 273 of I.P.C. and 47 (a) of Bihar Excise (Amendment)Act.

The accusation is of recovery of foreign liquor from the car in which the petitioner was sitting beside the driver. It is submitted on behalf of the petitioner that he was neither owner of the said car nor he was driver of the car. He has got no criminal antecedent. He is in custody since 4.9.2016. Considering the aforesaid facts and circumstances of the case, let the petitioner, abovenamed, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like
