Learned counsel for the petitioners are permitted to remove the defect(s), as pointed out by the office, if any, within a period of three weeks on resumption of physical mode. Petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 325, 307, 379, 427, 504, 506 and 34 of the Indian Penal Code. No.68611 of 2021(2) dt.06-06-2022 2/3 written report before the Officer Incharge of Mani Police Station on 04.05.2021 stating therein that on 30.04.2021, the accused petitioners are cultivating the field of wheat and maize. On being protested, they started assaulting the informant on his head causing head injury and his hand got fractured and the petitioners assaulted the informant with Lathi, Danda also and Sanjit Yadav took ornament of the informant and threatened. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. He further submits that it appears from the FIR that there is general and omnibus allegation of assault of against all the accused persons and there is no specific allegation against the petitioners.

He further submits that injury report in the case diary suggest that the injury is abrasion, swelling which is simple in nature. He further submits that the petitioner no. 2 and 5 are arrested and anticipatory bail with regard to the said petitioners, namely, Sanjit Yadav and Sikandar yadav became infructuous.

Learned A.P.P. for the State has opposed the bail petition of the petitioners.

Considering the aforesaid facts and circumstances, let the above named petitioners, except petitioner No. 2 and 5, in

No.68611 of 2021(2) dt.06-06-2022 3/3 the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate Khagaria in connection with Mansi P.S. Case No. 141 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
