The petitioner apprehends his arrest in connection with Muzaffarpur Mahila P.S. Case No. 42 of 2022 instituted under Sections 341, 342, 376 of the Indian Penal Code and Section 4 and 6 of the POCSO Act.

The allegation in the FIR is that the petitioner offered the informant that he will make her learn scooty driving and accordingly, in the night, as she went out along with him and was learning how to drive the scooty, he took her to a hut near Mirapur Road, raped her and thereafter escaped. She was frightened and was standing alone outside the hut when some unknown persons came and enquired about her being present at that secluded place and after taking the phone number

Patna High Court CR. MISC. No.57897 of 2022(2) dt.24-01-2023 2/2 of her father, informed her family members whereafter her parents along with the former 'Mukhiya' came and took her home. Accordingly, the FIR was lodged.

A bare perusal of the FIR would show that specific allegation of rape against the minor girl has been made against the petitioner herein and as such, this Court is not inclined to extend him relief of anticipatory bail which is accordingly rejected.
