ANJANA MISHRA ORAL ORDER 04-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 22.07.2019 in connection with Khizersarai P.S. Case No.210 of 2019 registered for the offence under Section 30(a) of the Bihar Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries of 40 litres of country made Mahua wine were not from the conscious possession of the petitioner, but from the motorcycle of the petitioner.

Considering the aforementioned facts and circumstances and that the petitioner is not having any criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with
