This application for anticipatory bail arises out of Sourbazar P.S. Case No. 124 of 2021 for the offence punishable under Sections 30(a), 41(1) of Bihar Excise and Prohibition Act, 2016.

It is claimed by the petitioners that the truck was sold to one Rajendra Turi in support of that he has annexed documents with the bail petition.

Considering the above submission, this application is allowed till submission of charge sheet.

Let the petitioners above named, in the event of his arrest/surrender within six weeks from today in the Court below

Patna High Court CR. MISC. No.68629 of 2021(2) dt.24-12-2021 2/2 be released on bail on furnishing bail bond of Rs. 10,000 (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-II-cum-Special Judge Excise, Saharsa in connection with Sourbazar P.S. Case No. 124 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, with a condition that after being released on bail the petitioners shall join investigation and the Investigating Officer will investigate the contention of the petitioners that they have sold the truck to one Rajendra Tori, if the contention is found true petitioners shall release on bail and if the contention is found false their bail bond shall be cancelled after submission of charge sheet.
