1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 137, 137(2) and 96 of the BNS.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that Abhishek Kumar kidnapped his minor daughter aged about 16 years with an intent to marry. Further, Abhishek Kumar called the wife of the informant on her mobile and demanded ransom of Rs.3 lakhs and said to handover the
Patna High Court CR. MISC. No.60163 of 2025(2) dt.16-09-2025 2/3 amount to the petitioners or else he will kill the victim. Further, the informant could hear the cries of the victim from behind, thereafter, Rahul Raj, brother of Abhishek Kumar came and threatened to handover the amount.
4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is further submitted that the date of occurrence is 18.09.2024 and the FIR came to be instituted on 01.10.2024 i.e. after a delay of 14 days without any plausible explanation. It is next submitted that the victim has come back and her statement was recorded under Section 180 of the BNSS wherein she has not supported the case of the prosecution rather has stated that she had gone to Delhi. It is also submitted that petitioners being father and brother of Abhishek Kumar came to be implicated in order to coerce Abhishek Kumar into submission.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by the learned counsel for the petitioners, let the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on

No.60163 of 2025(2) dt.16-09-2025 3/3 anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Aurangabad Town P.S.
