The petitioner has preferred this application for grant of regular bail in a case registered under sections 272 and 273 of the Indian Penal Code and section 30 of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 1100 litres of liquor was recovered from the agricultural land. The villagers disclosed that the petitioner and one another were involved in the business of liquor.

It is submitted by learned counsel for the petitioner that neither the petitioner was arrested at the spot nor was any incriminating article recovered from his possession. He has no concern with the seized liquor nor with the place of recovery. He is in custody since 8.9.2021 and the cause of his false

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the petitioner not having been arrested at the spot together with the period in custody being 8 months, the petitioner is directed to be enlarged on bail in connection with Kanti P.S. Case no. 68 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur.
