2. The petitioner has preferred this application for grant of regular bail in connection with Hajipur Sadar P.S. Case No. 118 of 2025 dated 15.02.2025 registered for the offences punishable u/s 309(6) of the B.N.S.
3. As per the prosecution case, on 14.02.2025, the informant alleged that one person booked his Swift Dezire Car from Rajendra Nagar Station to Hajipur and during course of travelling, the informant reached Hajipur Balwa Kunwari then one other person also boarded in his vehicle. Thereafter, both persons took the informant to a deserted place near a brick kiln and assaulted him and took his vehicle, a golden chain worth
Patna High Court CR. MISC. No.56930 of 2025(2) dt.20-08-2025 2/3 Rs. 55,000/-, a golden ring wroth Rs. 12,000/-, smart watch and a mobile phone and fled away. It is further alleged that the informant shared the said information with the patrolling vehicle of Sadar Police Station and he also alleged that his vehicle was fitted with GPS due to which the said vehicle was recovered in an abandoned place in Khilwat village near Ramjanki Temple.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The petitioner was not apprehended from the place of occurrence. Nothing has been recovered from the conscious possession of the petitioner. No T.I.P. has been conducted by the prosecution. The petitioner has no concern with the alleged offence. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 22.03.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of
Patna High Court CR. MISC. No.56930 of 2025(2) dt.20-08-2025 3/3 the like amount each to the satisfaction of learned Court concerned, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No. 118 of 2025.
7. The application stands allowed.
