Petitioner seeks regular bail in connection with Hasanpur PS Case No. 174 / 2021 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Amendment Act 2018.

888.555 liters of illicit foreign liquor has been recovered from the Hywa owned by the petitioner. Learned counsel for the petitioner submits that petitioner has been made accused merely because he happens to the owner of the Hywa. The petitioner was not present at the place of occurrence. At the time of occurrence the Hywa was being plied by its driver and the petitioner was not aware about the fact that driver has kept illicit liquor in the same. The petitioner is in custody since 27-8-2021 and charge

Regard being had to the submissions made by the parties, taking into consideration the material on record, the fact that petitioner has got no criminal antecedent, he is in custody since 27/8/2021, charge sheet has already been submitted and there is no likelihood that petitioner will abscond or tamper with the evidence and as such, I am inclined to grant regular bail to the petitioner.

Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand ) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II cum Special Judge, Excise, Samastipur in connection with Hasanpur PS Case No. 174 / 2021.
