Petitioners, apprehend their arrest in connection with Sadar P.S. Case No. 464 of 2016 registered for the offences punishable under Sections 406 and 420 of the Indian
Patna High Court CR. MISC. No.59462 of 2019(5) dt.29-11-2019 2/3 Penal Code.
Complainant has alleged that petitioners and other co-accused committed forgery for job in the Railway Class -IV post and demanded Rs. 6 lacs. Thereafter, complainant and his companion paid Rs. 75,000/- to accused no.1 and 2 in cash. It is further alleged that in the account of accused no.2 (Manish) Rs. 25,000/- was deposited and altogether Rs. 3,10,000/- were deposited in the account of accused nos. 1 and 2.
It has been submitted on behalf of the petitioners that they are innocent and have been falsely implicated in this case. It has been further submitted that only Rs. 25,000/- is stated to be deposited in the account of Manish Kumar Jha. Petitioners have no criminal antecedent.
Considering the facts and circumstances of the present case, let petitioners, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on prearrest bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saharsa, in connection with Sadar P.S. Case No. 464 of 2016, subject to the condition
Patna High Court CR. MISC. No.59462 of 2019(5) dt.29-11-2019 3/3 as laid down under Section 438(2) of the Code of Criminal Procedure and also subject to condition that petitioners will refund Rs. 25,000/- to the informant.
