JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 06-09-2017 Heard learned counsel for the petitioner and the learned counsel representing the State.

The petitioner wants to renew the prayer of bail which was earlier rejected by order dated 05.07.2017 passed in Cri. Misc. No. 10990 of 2017, on the ground that the petitioner has completed all the work according to the estimate. The allegation of misappropriation of money is vague and general and is not specific against the petitioner, no misappropriation was done by any one and only on the imaginary story the case has been lodged and as such, the petitioner deserves sympathetic consideration. The learned A.P.P. opposes the prayer of pre-arrest bail by submitting that the investigating officer has visited different places of occurrence and found that no work was done, the petitioner was acting as agent and he misappropriated the fund.

No.39050 of 2017 (3) dt.06-09-2017 2/2 In the facts and circumstances stated above, finding no good ground for reconsideration of prayer of the bail, again prayer of the bail of the petitioner stands rejected. However, in case and if so advised the petitioner surrenders and seeks regular bail then his prayer for regular bail shall be considered preferably on the same day on its own merits without being prejudiced by the order of this Court.
