JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 17-10-2017 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the state.
In this application for anticipatory bail the petitioners apprehend their arrest in connection with Patliputra P.S. Case No. 59 of 2017 for the offences punishable under sections 341, 323, 342, 307, 504, 506 and 420/34 of the I.P.C.
Allegedly, amount of Rs. 3,00,000/- was paid in the account of Abhishek Chandan on the assurance that the informant will get employment in the post office and when the employment was not made then the informant was called to return his amount
Patna High Court Cr.Misc. No.49300 of 2017 (2) dt.17-10-2017 2/2 by Abhishek and when the informant went in his house he was abused and assaulted with hockey stick, danda and chair. Submission is of false implication and that now the case has been compromised, the amount of Rs. 3,00,000/- has already been returned, vide Annexure-2, now there is no dispute between the parties and as such the petitioners deserve sympathetic consideration.
The learned A.P.P. fairly submits that vide Annexure2 the case has been compromised and the amount has already been returned.
In the facts and circumstances stated above, the petitioners, in case of their arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Ratneshwar Kumar Singh, J.M 1st Class, Patna in connection with the aforementioned case, subject to the condition as laid down under section 438 (2) of the Cr.P.C.
