JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 23-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

Allegedly, the informant's vehicle was stolen on 22.09.2014 from Sheikhpura. Upon search, the informant himself found the said vehicle in Dumka and after being returned from there; he instituted the First Information Report on 25.09.2014, implicating the petitioner as an accused.

Learned counsel for the petitioner submits that the prosecution story is highly improbable. He has submitted that the petitioner is an employee of the

Patna High Court Cr.Misc. No.48245 of 2014 (2) dt.23-04-2015 2/2 informant and was demanding arrears of salary which was due since long. He has further submitted that there has been inordinate delay in institution of the First Information Report and explanation for such delay cannot be said to be cogent.

It has been stated in paragraph no. 3 of the application that the petitioner has no criminal antecedent. In view of the submission as above, let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sheikhpura, in connection with Sheikhpura P.S. Case No. 387 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
