NILU AGRAWAL ORAL ORDER 01-12-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
Petitioner is languishing in judicial custody since 13.08.2016 in connection with Sherghati (Dobhi) P.S. Case No. 381 of 2016 registered for the offence punishable under Sections 366(A), 504, 506/34 of the Indian Penal Code. The prosecution case, as lodged by the informant, is that while she had gone to paddy seeding, her daughter, Musaraf Praveen was taken away by the petitioner for the purpose of marriage. When the informant went to the petitioner's house, his parents abused and assaulted her.
It has been submitted by the learned counsel for the petitioner that he is innocent, has no criminal history and the
Patna High Court Cr.Misc. No.51368 of 2016 (2) dt.01-12-2016 2/2 victim girl in her statement under Section 164 of the Cr.P.C. has stated that she went with the petitioner out of her own sweet will, as her mother had scolded her. It has further been submitted that the informant has already compromised the matter, as the case had been lodged due to misconception.
However, learned A.P.P. for the State submits that the petitioner is named in the First Information Report, hence, opposes the prayer for bail.
Be that as it may, considering the facts and circumstances and submission of the parties, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Sherghati (Dobhi) P.S. Case No. 381 of 2016.
