====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 11-10-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Siswan P.S. Case No.166 of 2023 dated 14.06.2023 instituted under Sections 341, 323, 324, 504, 506, 307, 379/34 of the Indian Penal Code.

3. As per the prosecution case, the informant went to bring his wife from her parental house where his father-in-law, brother-in-law (petitioner) and wife of petitioner abused the informant and assaulted by means of iron pipe on his head causing injury to him and also snatched Rs.10,000/- and his golden chain.

4. Learned counsel for the petitioner submits that petitioner is innocent and having been falsely implicated in this

He further submits that there is no specific allegation of assault against the petitioner and the injury sustained by the informant is simple in nature. Learned counsel also submits that both the parties are near relative and the petitioner has no criminal antecedent.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousands) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Siwan in connection with Siswan P.S. Case No.166 of 2023, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
