====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 24-05-2022 Heard Mr. Yogesh Chandra Verma, learned senior counsel for the petitioner and Mr. Nitya Nand Tiwary, learned Additional Public Prosecutor appearing for the State.
Petitioner seeks regular bail in connection with Phulwari P.S. Case No. 845 of 2018 (Sessions Trial No. 265/2020) registered for the offences punishable under Sections 304-B/34 of the Indian Penal Code 1860. This is second attempt for grant of regular bail on behalf of the petitioner inasmuch as earlier the bail application of the petitioner was rejected by a co-ordinate Bench of this Court vide order dated 04.11.2010 passed in
Patna High Court CR. MISC. No.69799 of 2021(2) dt.24-05-2022 2/3 Cr. Misc.74777 of 2019.
The allegation is that after one year of the marriage, the daughter of the informant gave birth to a child, and, thereafter, the petitioner and his family members started demanding a sum of Rs.3,00,000/- as dowry and due to non-fulfillment of the said demand, the accused persons killed the daughter of the informant.
Learned senior counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case on this basis of concocted story. He next submits that the petitioner is in custody since 12.10.2018 and the trial is not likely to be concluded in near future.
Regards being had to the submission made by the parties and taking into consideration the the period of custody, the tardy progress of trial and this is second attempt for grant of bail, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like
Patna High Court CR. MISC. No.69799 of 2021(2) dt.24-05-2022 3/3 amount each to the satisfaction of learned Additional District Judge XXI, Patna, n connection with Phulwari P.S. Case No. 845 of 2018 (Sessions Trial No. 265/2020) subject to the condition that the petitioner will be well represented on each date in the trial and if he fails to do so on two consecutive dates, his bail bonds will be liable to be cancelled.
