The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 346, 363, 366B, 370, 371, 372, 373, 354, 354B, 506, 34 of the Indian Penal Code, Section 3, 4, 5, 6, 7 of the Immoral Traffic (Prevention) Act, Sections 8, 12, 17 of the POCSO Act and Section 75 of the J.J. Act.

As per prosecution case, the informant got information that some minor girls were being forced to do obscene dance in an Orchestra Group. Thereafter, the informant along with police officials raided the said Orchestra and recovered a Nepali minor girl and arrested the petitioner namely, Sujit Kumar. Further, It has come to know that the petitioner

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case out of grudge of the informant. The victim girl recovered and stated in her statement recorded under Section 164 of Cr.P.C. that she was acquainted with the petitioner and also solemnized marriage with him. She did not whisper about misbehave or commission of wrong by the petitioner. A statement has been made in para-3 of the petition that the petitioner has got no criminal antecedent. It is further submitted that the petitioner is languishing in judicial custody since 4.8.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Majhauliya P.S. Case No. 568 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions
