JUSTICE CHAKRADHARI SHARAN SINGH ORAL JUDGMENT Date: 23-11-2017 The petitioner is aggrieved by the decision of the managing committee of Government High School, Piraunchha, whereby the petitioner has been removed from the membership of the Managing Committee of the said School.
It is the case of the petitioner that he being the grand son of the person, who had donated land for establishment of the said School, was included as donor member in a meeting held on 04.10.2014. After having been included as member in the Managing Committee on 04.10.2014, he could not have been removed before completing five years of his term, as prescribed under the Government
Patna High Court CWJC No.18556 of 2016 dt.23-11-2017 2/2 Notification, dated 23.05.2001.
It is not the case of the petitioner that apart from the donation made by his grand father, any donation was made by the petitioner himself. The petitioner, admittedly, did not make any donation to the School. His inclusion in the Managing Committed, as donor member itself, was bad.
In such circumstance, the claim of the petitioner that he should remain as member of the Managing Committee as donor is baseless.
