2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 307/379/34 and other ancillary sections of the Indian Penal Code.
3. As per the prosecution case, petitioner no.1 assaulted with spade on the head of the informant. Injury caused by him was dangerous to life as per doctor.
4. In view of nature of injury caused by petitioner no.1, his prayer for bail is rejected.
5. Petitioner no.2 is alleged to have assaulted the informant by means of bamboo. She is a lady and has got clean
Patna High Court CR. MISC. No.62275 of 2023(2) dt.11-10-2023 2/2 antecedent. Considering this fact, prayer for bail of petitioner no.2 is allowed. In the event of arrest/surrender within six weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kishanganj in Bahadurganj Police Station Case No. 205 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
