In the night of 16/17.08.2016, informant's brother Jai Mangal Sharma was shot dead and his dead body was found in a lane in front of the house of the informant. He had shown suspicion against one Matang Pandey on account of some sort of dispute whereunder Matang Pandey had confined the deceased along with Dablu Sharma on the pretext of being responsible for theft of battery. Furthermore, the informant apprehended that in said course petitioner, Sri Ram Pandey along with others might have actively involved themselves.

From perusal of the case diary, it is evident that charge-sheet had already been submitted against the petitioner and others, however, from the statement of the witnesses, it is apparent

Patna High Court Cr.Misc. No.50610 of 2016 (3) dt.12-01-2017 that they have shown simply suspicion against the petitioner. Nothing more than suspicion has been collected by the Investigating Officer.

Accordingly, petitioner, SRI RAM PANDEY @ SIYA RAM PANDEY is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in Tarari PS Case No. 53/2016.
