The petitioner seeks bail in connection with Kharik P.S. Case No. 52 of 2012 for the offences punishable under Sections 302/34, 429/34 of the Indian Penal Code & Section 27 of Arms Act.
The petitioner wants to renew the prayer of bail which has already been rejected by order dated 29.11.2013 passed in Criminal Miscellaneous Case No.26195 of 2013 on the ground that up till now only four prosecution witnesses have been examined and trial is not likely to be concluded in near future and
Patna High Court Cr.Misc. No.47202 of 2015 (3) dt.15-12-2015 2 / 2 the petitioner is suffering in custody since 08.08.2012. Coaccused Niranjan Singh has been allowed bail by different Bench of this court.
Considering the allegations that this petitioner and co-accused Asho Singh fired which caused injury and proved fatal for the deceased and allegation during investigation has also been corroborated and as such finding no good ground of reconsideration of prayer of bail, again prayer of the petitioner stands rejected.
However, considering the detention of the petitioner the trial court is directed to expedite the trial and to conclude the same preferably within nine months.
