The petitioner apprehends his arrest in Araria (Bairgachhi)P.S.Case No. 484 of 2013 dated 24-10-2013 under section 304(B)/34 of the Indian Penal Code.

Brother of the deceased made allegation that his sister Kalpana Devi was married to Naresh Mandal, S/o Gulab Chand Mandal, but after marriage her husband and in-laws were demanding different articles. It is alleged that the accused persons killed his sister.

It is submitted that the petitioner is brother-in-law of the

Patna High Court Cr.Misc. No.49240 of 2014 (2) dt.06-04-2015 2 / 2 husband of the deceased and has no connection with the family affairs of the husband of the deceased. The petitioner is living in a different village.

Considering the fact that the informant named the petitioner but did not make any specific allegation against the petitioner, who is brother-in-law of husband of the deceased, the petitioner is directed, in the event of arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, to be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Araria(Bairgachhi)P.S. Case No. 484 of 2013, subject to the conditions as laid down under section 438(2) Cr.P.C.
