JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-09-2019 Petitioners seek bail in anticipation of their arrest in connection with Govindganj (Malahi) P.S. Case No.140 of 2019, registered for the offences punishable under Sections 147, 341, 302, 504/34 of the Indian Penal Code.

Allegation against these petitioners is that they arrived at the door of the informant and abused father of the informant. Further allegation is that other co-accused persons assaulted the deceased at several places of body.

Submission of the learned counsel for the petitioners is that F.I.R itself shows that occurrence took place due to altercation between the children of both sides. There is no specific allegation of assault against these petitioners. They

Heard learned A.P.P. and learned counsel appearing on behalf of the informant, they have opposed the prayer of bail. In view of the above facts and circumstances, let petitioners, above named in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of the learned Additional Additional Chief Judicial Magistrate, Motihari, East Champaran in connection with Govindganj P.S. Case No.140 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
