JUSTICE ARUN KUMAR ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner apprehends his arrest in connection with Belaganj P.S. Case No.111 of 2015, registered under Sections 407/420/435/34 of the Indian Penal Code.

Allegation in brief is that the informant was getting 1000 liters of refined oil being transported from the factory to Siwan and on the way the driver misappropriated the oil and put the truck on fire and he had also diverted the route and suspicion is also raised against the truck owner.

Learned counsel for the petitioner submits that this petitioner is the truck owner and main culprit, the truck driver has been granted anticipatory bail by a coordinate Bench of this Court by order dated 20.12.2016, passed in Cr. Misc. No.52019 of 2016

Patna High Court Cr.Misc. No.37329 of 2017 (2) dt.10-08-2017 2 / 2 and the petitioner has got no criminal antecedent. Having considered the said facts and circumstances, the petitioner being owner of the truck and the specific allegation is against the driver of the truck, so in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let petitioner, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Belaganj P.S. Case No.111 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
