Petitioners seek bail in connection with G.R. No. 2454 of 2010/ Trial No. 765 of 2016 arising out of Pauthu P.S. Case No. 65 of 2010 registered under Sections- 302/34 of the Indian Penal Code and section 27 of the Arms Act. Learned counsel for the petitioners submits that petitioner was only a member of the mob. It is further submitted that the allegation of firing is against two other accused persons and there is nothing specific against the petitioner. It is further submitted that similarly situated co-accused namely, Baikunth Sharma and Narayan Sharma have been granted bail by this Court vide Cr. Misc. No. 38885 of 2011 and 27804 of 2016.
Patna High Court Cr.Misc. No.49778 of 2016 (2) dt.14-12-2016 Considering the facts and circumstances of the case and the fact that similarly situated accused persons have been granted bail by this Court, the petitioners above named are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Sessions Judge, III, Aurangabad in connection with G.R. No. 2454 of 2010/Trial No. 765 of 2016 arising out of Pauthu P.S. Case No. 65 of 2010.
