Case No.06 of 2013 registered for the offences punishable under Sections 406 and 506 of the Indian Penal Code. Apprehending arrest, the petitioner filed A.B.A. No.106 of 2013 in the court of A.D.J.,Sheikhpura. The same was dismissed on 4.3.2013. Hence, this application for grant of anticipatory bail under Section 438 of Cr.P.C. Heard learned counsel for the petitioner and learned A.P.P. for the State.
Even from the F.I.R., it is not evident that the informant has received any physical injury. The entire allegation is an alleged act of cheating by the petitioner in relation to supply of labourers to work in a brick-kiln. In a case of this nature, it is not
Patna High Court Cr.Misc. No.15161 of 2013 (3) dt.01-04-2015 2/2 essential that the accused must be arrested. Hence, the application is allowed.
In the event of arrest, the petitioner is directed to be released on bail on furnishing bail-bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheikhpura, in connection with Ariari P.S. Case No.06 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
