2. The petitioner is praying for regular bail in a case registered for the offence punishable under Sections 376 & 506 of the Indian Penal Code and Section 4 & 6 of the POCSO Act.
3. The case of the prosecution is that the minor daughter of the informant started weeping. When the informant asked her she told that while she was playing outside the house, the petitioner called her and put her finger in her genitals. After this he also threatened her of dire consequences.
4. During course of hearing, learned counsel for the petitioner has submitted that the informant deals in liquor and a month prior to this occurrence, a case under Excise Act was filed against her. She on the assumption that the alleged case may have been filed by the petitioner, has filed this case. In medical
Patna High Court CR. MISC. No.65544 of 2024(4) dt.16-01-2025 2/2 examination the Doctor has not found anything remarkable. It has also been argued by the learned counsel for the petitioner that the petitioner is aged about 45 years and he is having grown-up children. They are next door neighbour.
5. Learned counsel for the informant has vehemently opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Rohtas (Amjhor O.P.) P.S. Case No.170 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-VII-cum-Exclusive Special Judge, Prevention of Children from Sexual Offences (POCSO) Act, Rohtas at Sasaram.
7. Accordingly, the present bail application stands allowed.
