This application is for grant of anticipatory bail for the offence under Sections 302, 201 & 34 of the Indian Penal Code. It is submitted on behalf of the petitioner that from perusal of the FIR itself it appears that there is no allegation against the petitioner and even the police after investigation submitted final form against the accused persons including the petitioner. The learned Magistrate has taken cognizance against the accused persons under Section 302 of the Indian Penal Code. Heard learned A.P.P. also, who has submitted that from perusal of the complaint petition itself, it appears that the allegations are against the petitioner and from the impugned

Patna High Court Cr.Misc. No.53880 of 2016 (3) dt.11-01-2017 order, it appears that Paragraph Nos. 4, 5, 6 and 7 shows the complicity of the accused persons.

Having heard both sides. In view of the facts as stated above, I am not inclined to grant anticipatory bail, let the petitioner surrender before the court below and make prayer for regular bail, which will be considered by the learned court below after perusal of the entire materials, and will pass appropriate order as soon as possible.

With the above observation this application is dismissed.
