This application has been filed for anticipatory bail arises out of Kanti P.S. Case No. 587 of 2020 for the offense punishable under Sections 30(A) of Bihar Prohibition Excise Act 2016.

Considering the fact that the petitioner was not apprehended on the spot and the recovery is from behind the back of the poultry farm of Nikku Singh and Chinku Singh and considering the observations of the Supreme Court in the order dated 19.09.2022 (Annexure-02), this application is allowed. Let the petitioner, above named, in the event of his his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs.

Patna High Court CR. MISC. No.64077 of 2022(2) dt.30-11-2022 2/2 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise Court-II, Muzaffarpur in connection with Kanti P.S. Case No. 587 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. The petitioner will visit Kanti Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result into cancellation of bail bond of the petitioner.
