Although petitioner is named in the first information report but according to the prosecution case itself, alleged occurrence took place on account of land dispute and it was co-accused Bijendra Yadav who opened fire on the deceased. Moreover, there is case and counter case and some co-accused persons having more or less similar allegation have already been granted privilege of bail. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in Salkhua P.S. Case no. 246/2014.
