JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 19-09-2017 Heard learned counsel for the petitioners and learned and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with K. Hat (Maranga) P.S. Case No.427 of 2017 registered under Sections 341, 323, 324 and 307/34 of the Indian Penal Code. Regard being had to the fact that the petitioner no.1 Md. Nijamuddin @ Nezam is alleged to have fired causing injury on the left leg of the informant and petitioner no.2 Md. Mukhtar Alam @ Md. Mukhtar also assaulted the informant, I am not inclined to grant pre-arrest bail to the petitioners. Accordingly, the prayer for grant of pre-arrest bail is rejected.

In case the petitioners surrender and seek bail, the same

Patna High Court Cr.Misc. No.41438 of 2017 (2) dt.19-09-2017 2/2 shall be considered on its own merits without being prejudiced in any manner by this order.
