The petitioner seeks bail in a case registered under Sections 147, 148, 149, 341, 323, 307, 302 of the Indian Penal Code.

Allegation is that the accused persons including the petitioner assaulted the son of the informant with lathi, danda and sword. Accused Rama Shankar Ram gave blow on the head of informant's husband, who died on the spot. The accused persons also badly assaulted informant's son, due to which he received injuries and he was taken to the Hospital for treatment. It has been submitted on behalf of the petitioner that the petitioner is in custody since 8.5.2019 and has got no criminal antecedent. Charge sheet has been submitted in this

Patna High Court CR. MISC. No.54697 of 2019(2) dt.30-08-2019 2/2 case. There is no allegation of tampering of witnesses alleged against the petitioner. The main allegation of assault is against co-accused Rama Shankar Ram. There is no allegation of assault against the petitioner upon the deceased. The petitioner and other co-accused are said to have assaulted the son of the informant. No offence under Section 302 of I.P.C. is made out against the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Siwan in connection with Barharia P.S. case No.149 of 2019.
