Petitioner is languishing in custody since 08.09.2016 in connection with Rajauli P.S. Case No. 225 of 2016 for offences punishable under Section 47(A) of the Bihar Excise (Amendment) Act, 2016.

From a vehicle the police recovered foreign liquors in different bottles on 07.09.2016. The petitioner and others were arrested at the spot traveling in the same vehicle. Submission is that the petitioner has got no criminal antecedent nor the said vehicle belong to the petitioner rather the petitioner was a passenger.

Considering the facts and circumstances, let

Patna High Court Cr.Misc. No.50695 of 2016 (2) dt.23-11-2016 2/2 petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Rajauli P.S. Case No.225 of 2016.
