The petitioner is accused in connection with Dharhara P.S. Case No. 40 of 2016 registered under sections 302, 201/34 of the I.P.C. and section 27 of the Arms Act pending in the Court of Judicial Magistrate, 1st Class, Munger. The accusation against the petitioner is of killing. Submission is that there is no eye witness of the case. The petitioner has falsely been made accused mere on suspicion. It is also submitted that petitioner is in custody since 22.04.2016.
Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that on
Patna High Court Cr.Misc. No.49501 of 2016 (4) dt.13-02-2017 2/2 perusal of the paragraph nos. 22 and 25 of the case diary, there is sufficient material against the petitioner to show his involvement in the murder of son of the informant and the petitioner had also love affair with wife of the deceased.
Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.
