The petitioner is apprehending his arrest in connection with Banka Mahila P.S.Case No. 19 of 2017 registered for the offence under Sections 448, 341, 323, 354, 504 and 506/34 of the Indian Penal Code.

Allegation against the petitioner is that he made assurance to marry the girl but thereafter he refused to marry her and there is allegation that she was assaulted and threatened and it is also alleged that he made physical relationship with her. Submission of learned counsel for the petitioner is that there is no such allegation of making intercourse and the case has been lodged to create pressure for marrying her. Heard learned APP also.

No.36532 of 2017 (2) dt.10-08-2017 2/2 Having heard both sides and in view of the facts and circumstances, let petitioner surrender and make prayer for regular bail, which will be considered by the court below keeping in view the fact that though in her statement under Section 164 Cr.P.C. when she has alleged regarding intercourse but in her earlier statement there is no such allegation and further the false case has been lodged in order to create pressure upon the petitioner for marrying her and will dispose of the application, preferably on the same day, without being prejudiced by this order. With the above observation, this application is disposed of.
