The petitioner apprehends his arrest in Bihiya P.S. Case No.260 of 2019 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The informant got information that Bhuar @ Jitendra Yadav (petitioner) and Dhananjay Prasad were selling liquor at different places. On such, a raid was conducted and in front of the shop of petitioner, the liquor was recovered. Again a search was made at the place where the petitioner was selling liquor near orchard of Tiwari Jee from there 31 pouches of liquor were recovered.

Learned counsel for the petitioner submits that the petitioner has got no concern with the recovery made from the orchard but it appears that it was the petitioner, who was selling

Patna High Court CR. MISC. No.53993 of 2019(2) dt.28-08-2019 2/2 liquor near the orchard of Tiwari Jee, on such a raid was conducted and liquor was recovered.

Having considered the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
