JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 10-02-2017 Heard learned counsel for the petitioner as well as learned APP.

A demand of ransom was made through Mobile of the informant from SIM Nos. 07532097511 as well as 09069950972 and further in case of failure, to face dire consequences.

During course of investigation, petitioner was apprehended and from whose possession mobile sets were recovered having SIM tallying with whatever alleged in the written report. From the case diary, it is evident that not even a single farthing has passed over on account of aforesaid threatening. Though the petitioner has got chequered history but is under custody since 09.07.2016.

That being so, petitioner Baidyanath Paswan is

Patna High Court Cr.Misc. No.49670 of 2016 (4) dt.10-02-2017 directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Begusarai in Garhpura PS Case No. 42/2016, subject to the condition that till conclusion of trial neither petitioner nor his associates will ever contact the informant which should be an undertaking before tendering of the bail bonds.
