The petitioner has prayed for regular bail in a case registered for the offence punishable under section 394 of the Indian Penal Code.

As per prosecution case, while the informant was returning from clinic after collecting blood sample on his motorcycle bearing Registration No. BR30-V-1609, in the meantime, some miscreants came near him and started assaulting him and took away his motorcycle.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is not named in FIR rather he has falsely been implicated in this case. It is further submitted that during

Patna High Court CR. MISC. No.59823 of 2022(2) dt.07-02-2023 2/2 investigation, the name of the petitioner has been dragged in this present case on the basis of confession made by him in other case Dumra P.S. Case No. 90 of 2022. The petitioner has not been put on T.I.P, nor any incriminating article has been recovered from his possession which connected his complicity in this case. It is further submitted that the petitioner is languishing in judicial custody since 8.6.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Dumra P.S. Case No. 01 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi.
