The petitioner no.1 and opposite party no.2 are physically present before this Court. They have communicated to this
Patna High Court Cr.Misc. No.16622 of 2013 dt.08-02-2017 Court that they are living peacefully at their place of work at Muradabad. Now they have amicably settled their dispute. They are in peace. The petitioner no.1 undertakes that he will not cause any physical or mental harassment to the opposite party no.2. In view of restoration of the relationship between the parties, there is no need to keep the matter pending before the court below as it would be nothing but, an abuse of the process of the Court. In that view of the matter, the order dated 29.01.2010 passed by learned Judicial Magistrate, Patna City in Complaint Case No. 872 of 2009 is quashed.
Accordingly, the application stands allowed.
