2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 341, 323, 307, 504, 506/34 of the Indian Penal Code.

3. The allegation in the first information report is that the accused persons including the petitioner entered the courtyard of the informant and while hurling abuses, one Md. Nabir pushed the informant while Sebum Khatun gave a dabiya blow upon the head of the informant, while others assaulted with lathi.

4. Learned counsel for the petitioner submits that it would be evident from the first information report that the specific allegation of pushing and giving a Dabiya blow is upon two other accused persons Md. Nabir and Sebum Khatun who

Patna High Court CR. MISC. No.58622 of 2025(2) dt.29-08-2025 2/3 have already been granted anticipatory bail vide order dated 15.05.2025 passed in Cr. Misc. No. 1155 of 2025. It is further submitted that the FIR has been lodged after due thought and deliberation after four days of the occurrence and there is land dispute between the parties and the injury suffered by the informant is also simple in nature. It has also been submitted that the petitioner is a 65 years of old man with no criminal antecedent and is also suffering with paralysis.

5. Learned APP for the State opposes the prayer for bail.

6. Considering the facts and circumstances and also considering that there are general and omnibus allegations against the petitioner and also considering that other coaccused persons upon whom there are specific allegation have already been granted anticipatory bail, let the above named petitioner, who has no criminal antecedent, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Shrinagar P.S. Case
