The petitioner seeks bail in Khutauna P.S. Case No. 62 of 2019, instituted for the offence under Section(s) 272, 273 of the Indian Penal Code and Section 30(a) of the Excise Act.

It is alleged in the written report that 540 litres of Nepali liquor has been recovered from Xylo Car bearing registration No. BR-32PA-0771.

Counsel for the petitioner submits that petitioner has not been arrested on the spot.

Petitioner is in custody since 25.6.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of

Patna High Court CR. MISC. No.54028 of 2019(2) dt.03-09-2019 2/2 the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge of Excise Act, Madhubani, in connection with Khutauna P.S. Case No. 62 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioner.
