JUSTICE ARVIND SRIVASTAVA ORAL ORDER 22-09-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Nath Nagar P.S. Case No. 146 of 2017 registered under Sections 448, 386, 354B, 379, 506, 504 and 34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioners submits that F.I.R. is lodged after twenty days of the alleged occurrence. Further submission is that on perusal of Annexures no. 2 to 4, it appears that earlier petitioners have also filed complaint case against the opposite party and petitioners

Patna High Court Cr.Misc. No.37352 of 2017 (4) dt.22-09-2017 2/2 have taken Power of Attorney by the land lord for cultivation. Further submission is that informant has no right and title to the alleged land.

Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M., Bhagalpur in connection with Nath Nagar P.S. Case No. 146 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) Shailendra/- U T
