1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 366(A) and 34 of the Indian Penal Code.
3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is in custody since 07.06.2024 and charge-sheet has been submitted in this case, as such, no useful purpose would be served by keeping the petitioner in jail. It is next submitted that the informant alleges that the accused persons including the petitioner kidnapped her minor daughter.
4. The learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.60964 of 2024(2) dt.11-12-2024 2/2 petitioner has been falsely implicated in the instant case. It is next submitted that the victim and the petitioner were in love and they eloped. It is next submitted that the statement of the victim was recorded under Section 164 Cr.P.C. wherein she has not supported the case of the prosecution rather has stated that she was not abducted and is a major girl and has solemnized her marriage with Shambhu Kumar. It is also submitted that Sangeeta Devi and two others had approached this Court seeking anticipatory bail by filing Cr. Misc. No.23318 of 2022 and the same was allowed by an order dated 07.11.2022.
5. Learned A.P.P. opposes the bail application.
6. Considering the submissions made by the learned counsel appearing on behalf of the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai in connection with Bechhwara P. S. Case No.226 of 2021.
7. The application stands allowed.
