JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 413, 414 of the Indian Penal Code.

Allegedly, one stolen motorcycle was recovered from possession of the petitioner for which the present case was lodged and the petitioner was remanded in the present case from another case which was registered against him for the offences of Arms Act. However, petitioner claims that seized motorcycle belonged to Asif from whom petitioner had purchased the said motorcycle but before preparation of paper of transfer the petitioner was caught by the police. Moreover, there is nothing

Patna High Court CR. MISC. No.55080 of 2019(3) dt.27-11-2019 2/2 on the entire case diary to show that Asif had lodged any case of theft of the motorcycle.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Purnea in connection with Barahra P.S. Case No. 46 of 2019.
