JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is apprehending his arrest in a case registered for offences punishable under Sections 406/420 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that the present case is purely a case of civil dispute and no case is made out under Section 406/420 of the Indian Penal Code. Learned counsel for the petitioner further submitted that for the disputed amount, which is Rs. 4,51,250/- the petitioner is ready to pay the same in six monthly installments.

Considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest

Patna High Court Cr.Misc. No.49609 of 2016 (2) dt.14-12-2016 2/2 or surrender before the court below within a period six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Brahmpur P.S. Case No. 160 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure subject to the condition that the petitioner shall pay the aforesaid amount within a period of six months, in six equal installments, failing which, the bail bond furnished by him in the Court below shall stand automatically cancelled.
