JUSTICE BIRENDRA KUMAR ORAL ORDER 09-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272,273,420/34 of the Indian Penal Code and Sections 47A and 47G of the Bihar Excise Act.

Huge quantity of foreign liquor was recovered on 22.08.2016 from the field side and people available there informed that the petitioner was occupant thereof. The petitioner has stated on oath that he has got no criminal antecedent. Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days

Patna High Court Cr.Misc. No.49344 of 2016 (2) dt.09-12-2016 from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj/Successor Court in connection with Mirganj P.S. Case No. 235 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
