3. Learned counsel for the petitioner is permitted to make correction in para 4 of the petition during course of the day.

4. Heard learned counsel for the petitioner and learned APP for the State.

5. The petitioner seeks regular bail in connection with Sangrampur P.S. Case No. 229 of 2025 for the offences registered under Sections 30(a), 32, 41(i) of the Bihar Prohibition & Excise Act.

6. As per the prosecution case, there is recovery of 189.795 litres foreign liquor from the Baithka of petitioner along with two motorcycles.

7. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. There is no independent witness of the seizure-list. Petitioner has no concern with the seized liquor and motorcycles. Place of occurrence is open place which is accessible to public at large. Petitioner has one criminal antecedent which does not belong to Excise Act. He is in judicial custody since 20.06.2025. Petitioner undertakes to co-operate in the trial. It is submitted that co-accused persons, namely, Satish Kumar and Sonu Kumar have been granted bail by this Court, vide order dated 21.08.2025 passed in Cr. Misc. No. 56926 of 2025.

8. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

Considering the submissions made on behalf of the parties, facts and circumstances of the case, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 1, East Champaran, Motihari in connection with Sangrampur P.S. Case No. 229 of 2025.
