JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 08-11-2017 In view of the averments made in para 13 of the counter affidavit filed by the respondents which reads as under :- "That the statement made in paragraph no. 8 of the writ petition be correct. It is submitted that the names enlisted by the petitioner for issuance of ration card, has been forwarded to the department, but no ration card has been received by the answering respondent, Panchayat Secretary and B.D.O. If and when the list for distribution of ration card will be received from the Government, the persons shall be given ration card. It is further submitted that the answering respondent has got no power to issue ration card suo moto and so the fact is a distorted version of fact."

Patna High Court CWJC No.15077 of 2015 dt.08-11-2017 2/2 we dispose of the matter with a direction to the State Government to proceed to take action as indicated and to ensure that the irregularities in distribution of ration card and grant of B.P.L card are restored and the deserving persons are granted benefits.

With the aforesaid, the application stands disposed of.
