JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-12-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is in custody since 24.07.2016 in connection with Sadar P.S. Case No. 287 of 2016, registered for offences punishable under Sections 420, 409, 467, 408, 471, 379/120B of the Indian Penal Code.
It is submitted on behalf of the petitioner that save and except the confessional statement made by one co-accused, nothing has come on record to implicate the petitioner in the present case. There is no recovery from the conscious possession of the petitioner and the co-accused, who has named the petitioner in the present case, has already been granted the privilege of anticipatory bail vide order, dated 22.10.2016, passed in Criminal Miscellaneous No. 42908 of 2016 and also the co-accused,
Patna High Court Cr.Misc. No.49722 of 2016 (2) dt.13-12-2016 2/2 namely, Mukund Kumar Chaudhary, has also been granted the privilege of bail by this Court vide order, dated 02.12.2016, passed in Criminal Miscellaneous No. 45942 of 2016.
Considering the aforementioned facts and circumstances, the period of custody and also that other co-accused persons have been granted the bail, let the petitioner above named, be enlarged on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Sadar P.S. Case No. 287 of 2016, subject to the condition that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
