JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-12-2025 Heard Mr. Ramakant Sharma, learned senior counsel appearing on behalf of petitioners, learned A.P.P. for the State and Mr. Y.V.Giri, learned senior counsel appearing on behalf of informant.
2. The petitioners pray for regular bail in connection with Rajgir P.S. case No. 151 of 2025, registered for the offences punishable under Sections 103(1), 238(c), 61(2)(a), 3(5) of the Bhartiya Nayay Sanhita, 2023 and Section 27 of the Arms Act.
3. The prosecution case, in brief, is that the informant, Khusbu Kumari, alleged that on 18.03.2025, she came to know
Patna High Court CR. MISC. No.58673 of 2025(3) dt.12-12-2025 2/3 that her brother had gone missing in the night of 17.03.2025 and during course of search, the dead-body of brother of the informant was recovered from a well riddled with gunshot injuries.
4. Petitioners are not named in the F.I.R. Name of the petitioners transpired during course of investigation. The only material, which has come against petitioners, is that tower location of mobile phone of these petitioners was found near the place of occurrence. Petitioners have got clean antecedent and are in custody since 22.03.2025.
5. Learned senior counsel appearing on behalf of informant vehemently opposes the prayer for bail and submits that petitioners are cousin brothers of the deceased and due to property dispute, these petitioners in connivance with other coaccused persons committed murder of the deceased. During course of investigation, sufficient material has come against these petitioners to show their complicity in the occurrence.
6. In the facts and circumstances of this case as well as period of custody and clean antecedent, the prayer for bail of petitioners is allowed.
7. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with
